General Terms and Conditions

1. Completion of Contract / General

1.1 We deliver exclusively on the basis of our General Terms and Conditions

1.2 The contract of sale is accomplished through a confirmation of order if requested or by delivery of merchandise at the latest.

1.3 Orders can be placed only online by our webshop which is accessible via www.naturtuche.de on the internet.

1.4 Minimum order value is 15.- EUR. Minimum order value for cloth orders is 1 m per article. Only full meters are sold.

2. Prices and payment practice.

2.1 For the delivery the prices of our internet catalogue are valid at any time. All prices include the VAT (value added tax) and include mailing expenses and packaging. The VAT will be shown on the invoice.

2.2 For prepayment we allow a discount of 3%. Further discounts are granted to textile processing resellers, non-profit associations, public schools and state museums after submission of evidence. Please ask for conditions for payment reduction under: post @ naturtuche.de.

2.3 Our invoices are due immediately and payable without deductions. Prepayment by bank transfer or PayPal are required. Usually we do not ship on account. Regular customers with at least five (5) executed shipments are entitled to order on account. Delay of payment will cancel the right of order on account.

3. Delivery time

3.1 Within Germany articles on stock will be delivered at least 14 days after receipt of order. Shipment to the European Union will be delivered within three weeks and to the US within 6 weeks. In case of unexpected delays the customer will be informed immediately.

3.2 Delivery time is counted from the day of confirmed order.

4. Delivery, shipment, transfer of risk

4.1 Partial deliveries acceptable as far as these can be reasonably imposed to the customer.

4.2 We will define the dispatch type sequence and the company assigned for the shipping. For further details see under "Shipping and packaging costs".

4.3 The risk of the goods shall pass to the buyer as soon as they have been delivered through the freight forwarder.

5. Right of withdrawal

5.1 The customer has the right of withdrawal according to § 13 BGB of distance selling contracts. Based on §§ 312 d, 355 BGB he is entitled to withdraw from the contract within two weeks after receipt of the merchandise without giving reasons. The withdrawal can be executed in written form or by returning the merchandise.
To meet the deadline, timely mailing to our warehouse shall suffice:

5.2 In the exercise of the right of withdrawal the consignee bears the return costs for a consignment value up to 75,- EUR. Value reduction due to use of the consignment is covered by the consignee unless a loss of value is based only on an inspection of the consignment.

5.3 A right of withdrawal cannot be excepted for merchandise which were produced according to specifications of the customer, or cut from stock according to specifications of the customer or are not suited for return based on appearance or condition.

6. Refusal of acceptance

If a customer refuses acceptance of merchandise he has to bear all resulting costs, including storage costs.

7. Reservation of proprietary rights

Delivered merchandise is subject to reservation of title until completely payed.

8. The right of customer in cause of defects.

8.1 In cases of insignificant deviations in colour, sizes or other quality or performance features of the merchandise no claims of liability can be made. This does apply particularly on irregularities in the texture of cloth from natural fibers as well as variations in colour of fabrics, yarns and textiles dyed with natural dyer.

8.2 The customer is protected by the liability laws for defects according to the German Sales Law.

9. Entitlement to damages

The customer is not entitled to enforce claims for damages according to the German Product Liability Law, unless damage is caused by gross negligence and intent or violation of fundamental contract duties or failure to meet obligations of the seller.

10. Miscellaneous

10.1 The customer is responsible for a careful handling of materials with health risk.

10.2 Naturtuche are entitled to use all information on business connection with the customer according to the German Data Protection Act. For further details see under "Privacy Protection".

10.3 In the event that parts of the general terms and conditions are invalid this does not affect the validity of other provisons.

10.4 This agreement shall be governed by German laws, the courts of Marburg shall have exclusive jurisdiction in case of law suits.
